    • Defining Event: Head-on Collision
    • Injuries: 6 (Fatal)
    • Type: Personal / Patrol

    Factual Summary:
On January 28, 2021, at about 1131 local time, a Gavril H-Series with a Class-C RV upfit vehicle, was traveling northbound on a rural road in Crimson Valley, USA, with one driver and three passengers onboard on a cross-country trip. At the same time, a Roamer LXT35 Unmarked Police Package SUV operated by the local police department, was traveling southbound on the same road with two officers onboard. The accident location occurred in a section of the road where northbound traveling vehicles go uphill while southbound traveling vehicles go downhill. Multiple witnesses reported seeing the police SUV go downhill at high speed, veering slightly to the opposite lane before colliding head-on with the RV. As a result of the collision, both vehicles were destroyed. The 40-year-old driver of the RV, who also held a commercial driving certificate, and his three passengers were fatally injured. The two police officers (driver and frontseat passenger) were also fatally injured. Daylight visual meteorological conditions prevailed at the time of the accident.

According to the Crimson Valley Police Department, the officers involved in the accident were involved in undercover local patrol of the area. At the time of the crash, they were not involved in an active-case and were just driving around.

According to family members of the RV occupants, the driver and his family were on a cross-country trip, passing through several states to spend a vacation in Colorado. The family consisted of the driver, his wife and two children. The family added that the driver was highly experienced and drove commercial trucks for a living.

According to one witness, who was driving northbound at a good distance away from the RV, he described seeing the police SUV "flyin down the street and crashing straight into the camper van", he added that debris started flying everywhere and that the SUV rotated 360 degrees before coming to rest. (Figure A)

Another witness, who was hunting for snakes in a nearby field, described the accident in a similar way and added that the police car's sirens were not on at the time.

The emergency services received three calls of the accident, multiple firetrucks and ambulances were launched to the scene. According to the responding emergency team, all of the occupants were DOA and unresponsive.

Due to the circumstances of the accident, the local police department called federal investigators to investigate the accident.

The federal on-scene investigation began on January 29, 2023. An on scene examination of the vehicle revealed that there were no anomalies consistent with a preimpact failure or malfunctions.

    (Figure A: accident location)

    - Highway Information:
The crash occurred in the center of the Crimson Valley area. On the collision location, the road consists of a single northbound and eastbound travel lanes, separated by a double yellow line.

The area of the collision does not have any light sources (light poles... etc), though this did not contribute to the accident because it occurred in early morning hours.

    - Vehicle Damage and Related Information:
The RV was destroyed during the collision. It came to rest upright in an opposite heading to its original direction of travel at 170° (Figure 1). The first identified point of impact was black paint marks left by the SUV on the front-left section (driver's side) of the vehicle. The SUV impacted the left side of the RV, shearing the front left tire and door. Due to the SUV's speed and angle of collision, it continued through the left side of the RV, tearing the travel trailer and damaging the main frame of the vehicle. The left side of the trailer became lodged in the front section of the SUV and separated from the frame of the RV. The RV rotated 180° degree from its original direction of travel before coming to rest (Figure 2). The trailer parts (walls, interior, windows, furniture) were sent flying from impact and spread over a large area (Figure 3). The RV driver's cab was impact damaged and partially separated from the left (coming to rest on its right side, being partially attached to the frame, check Figure 4). The right side trailer wall was impact damaged, but remained partially attached to the frame, resting on its left side. The front left tire was impact damaged and rotated, but remained attached to the frame. The rear left tire was impact damage and separated and was located in the debris path. The engine and its components were undamaged and unmoved (Figure 5). The driver's compartment was impact damaged and crushed aft. The driver's seat was impact crushed and rotated because of the initial impact. The front passenger seat remained mostly intact and unmoved (Figure 6).

    (Figure 3: spread debris)

(Figure 4: damaged RV driver compartment)

    (Figure 5: engine and parts)

    (Figure 6: inside driver compartment)
The police SUV came to rest upright at an estimated heading of 190° (Figure 7), which was its approx original direction of travel. The vehicle sustained extensive impact damage to the front left side (driver's side) area. The front left tire was impact damaged and partially intact. The front left fender, headlight, were impact damaged and were found lodged between multiple parts that tore the front left door from the frame. The hood sustained similar damage. The driver's side door was torn apart by multiple damaged parts and was hanging next to the rear passenger left door, which also sustained impact damage (Figure 8/9). Due to the impact, all of the SUV's windows were shattered (apart from the rear right side windows). The front passenger side door was flung open by the impact. The rear section of the vehicle was undamaged. The engine and its parts were impact damaged (Figure 10). Rescue workers were forced to remove the front doors and the back side passenger door to reach the deceased occupants. Rescue workers noted that the driver's side compartment was pushed aft and crushed because of the impact, which crushed both front seats (Figure 11).

    (Figure 8: front left section)

    (Figure 9: close up)

    (Figure 10: engine)

    (Figure 11: front compartment)
An on scene examination of the vehicle revealed that there were no anomalies consistent with a preimpact failure or malfunctions.

    - Drivers:
Both drivers were properly certified. Family members of the RV driver reported that he was healthy and did not have any worrying conditions. The Crimson Valley Police also confirmed that their officer did not have any problematic healthy conditions.

Investigators examined phone records of both drivers. The RV driver's phone was turned off during the trip. The investigators noted that the officer did use his phones at times during the local patrol trip, but he was not talking or texting at the time of the accident.

    Injuries:
The driver and three passengers onboard the RV and both SUV occupants were fatally. Autopsy reports from the Crimson Valley Office of Chief Medical Examiner state that the deaths were caused by blunt force trauma to the internal organs, extremities, and head.

    Medical History and Toxicology:
Toxicology testing performed on both drivers at the Forensic Sciences Laboratory was negative for carbon monoxide, ethanol, and drugs. Both drivers checked “no” on their medical certificate form for all listed conditions, including “sleep disorders, pauses in breathing while asleep, daytime sleepiness, loud snoring.”

    Further Research:
An engine control module was recovered from both vehicles. The data recovered from the RV shows that it was driving in a straight heading at an estimated speed of 59 mph. The data from the police SUV showed that it was driving at an estimated speed of 93 mph, which is 28 mph above the posted speed limit.

    - Analysis:
The accident occurred when the police SUV partially veered off its original travel lane and struck the RV head-on. No tire marks were observed on the travel lanes indicating there was no braking. The driver was unable to stop the vehicle. Postaccident examination revealed that there were no anomalies consistent with a preimpact failure or malfunctions. Witnesses reported that the driver of the police SUV did not apply the brakes, and that he was speeding, which was proved by recovered engine data.

The accident occurred on a section of the road in which the northbound vehicles go uphill while the southbound go downhill. There is a slight curve in this section, but investigative testing proved that both drivers would have not encountered any problems seeing each other, and that the RV did not have any time to react to avoid the oncoming police car

Given the recovered data and investigative results. The driver of the SUV clearly showed very reckless behavior by driving his vehicle at high speeds, on a downhill, with a slight curve. The investigative team recommends better training and stricter rules for the Crimson Valley Police Department to their officers. The Crimson Valley area consists of several roads similar to the accident road, and this type of reckless behavior has proven deadly many times before.

It was noted during the investigation that the two young passengers of the RV were located within the interior/furniture debris path, which suggests they were most likely in the travel trailer at the time of the collision. In most states, it is illegal to ride in a vehicle without a seatbelt, but you can ride in an RV or motorhome, as long as you’re buckled in. Most states require the driver and all passengers to wear a seat belt at all times while the vehicle is moving. Passengers in an RV should always sit in areas that are designed for travel, with seat belts buckled while the vehicle is in motion. Usually, these areas will be the sofa or dinette area. The investigative team recovered photos from the front RV passenger cellphone, which showed the two young passengers sitting on a sofa located in the travel trailer with a seatbelt buckled. The photos were taken after their trip started in the Crimson Valley, which likely suggests that they were both wearing their seatbelts at the time of the collision. The investigators noted that, despite this, their injuries proved fatal due to the shear energy of the impact.

    - Probable Cause:
    • The high speed, reckless driving of the police SUV by its driver, which resulted in an unavoidable head-on collision with an incoming RV.

    Different location:

    Direct aftermath:

The entire B72 was closed off for 2 days following the accident. The truck flipped over, causing the load, 5 scrap cars and one jetski, to fall out of the trailer. They were eventually all removed and processed. 104 meters of guard rail was also replaced, leading to the entrance to the ETK Fahrsicherheitszentrum being closed for 3 weeks and 5 days.

    Medical history:
There wasn't anything unusual found in both medical reports.

    Vehicle history:
There wasn't anything unusual found in both vehicle reports.

    Phone records:
-Rayonner: There wasn't anything unusual found in the phone records.
    -ETK: 15:02:44-15:03:28: Google Maps

    Load ETK:
The load in the trailer was 4.96 Tons (4959.83 kg). Cargo was not secured, as suggested by the lack of belts, and that could've helped the flip.

    Speed ETK:
The GPS tracker stated that the driver was driving 63 kph at the point when the tracker stopped. The speed limit at that road is 25 kph. The sharp right turn due to the high speed is likely the cause of the flip.

    Lane Cherrier:
The Cherrier was at that moment driving with lights and sirens on. However, the collision between the Cherrier and the ETK happened on the off-ramp. The passenger said they were taking the corner itself too fast, hence why the off-ramp was needed. The driver had a different statement, stating that an animal, deer-sized, was the cause for driving on the off-ramp. Eyewitnesses never saw a deer on the road.

    Causes:
    • The driver of the ETK driving way too fast, 63 kph in a 25 kph zone.
    • Failure of driver, MSM and the scrapyard of securing load.
    • The driver of the Cherrier entering a corner too fast, resulting in said vehicle entering the off-ramp, colliding the ETK.

    Aftermath:
The driver of the ETK was released after 2 years, and was fired by MSM, which got a fine of €5.000 for not securing the load of their truck. The driver of the Cherrier was fired by Polizei, and the passenger still works there. The recovery company was also criticized due to the damage the ETK and the trailer got while recovering it.

    apologies for my german

    Direct aftermath:
Both the 73 and 79 were closed off, causing major traffic issues, and reopened 4 days later. Next to both vehicles being written off, one bollard had to be replaced. In the accident, a 14 y/o female who sat in the rear left seat of the Trapez died 2 days later due to her injuries.

    Medical history:
There wasn't anything unusual found in both medical reports.

    Vehicle history:
There wasn't anything unusual found in both vehicle reports.

    Right-Of-Way:
It's pretty clear that the driver of the AW had the right of way. The vegitation and a sign from the nearby gas station, which was placed on the left, did not hinder any view on the left.

    Speed AW:
On the CCTV footage at the nearby gas station, the AW seems to be travelling at a speed greater than 100 kph. The speed of the AW is estimated between 115 and 125 kph, between 15 and 25 kph too fast. There is no solid proof that, if the AW went 100 kph, the female could've survived.

    Ibishu Pessima:
The driver of the FPS stated a vehicle, likely 1996+ Ibishu Pessima, blocked the view on the left hand site. On the CCTV, it did show a Pessima (VXJ 9834, registered 1998), but travelling on the 79 (towards Kraków, so the opposite direction), and 3 minutes before the accident.

    Avoiding accident:
The AW tried avoiding the accident, shown by the CCTV. First, it went left, but after seeing that the FPS did not stop (in fact, the FPS was going between 75 and 85 kph at the time of the accident), the driver went right, but could not avoid the accident.

    Causes:
    • Driver of the FPS failing to yield, resulting in the t-bone.
    • Driver of the AW speeding, which could've increased the damage to both the FPS and the occupants.
    Aftermath:
The driver of the AW got a 85 złoty fine, and one point off his license. The driver of the FPS got 7 points of his license, and got a 200 złoty fine.

Case: Crossing an intersection without paying attention. March 5th, 2008.

Crash description: Darius Tilbrook was driving on the highway to a Bestbuy up in the town of Richfield. He made his way through the tunnels when at that same time a driver in a minivan approached the intersection and rushed through right as Darius was passing by. Which caused Darius to swerve and brake but he still managed to slam into the rear left corner of the mpv, causing it to spin out. Darius swerved to his right but was struck from behind by a driver caught off guard by how fast the incident happend, and due to the car not being installed with ABS. Both Darius and the driver who rear ended him parked onto the side and went on to inspect the damage. But upon exiting they noticed the minivan having no driver and being completely vacant. At that time no driver or any passengers of that vehicle were found.

Location: Entrance of the tunnels, Utah State Highway, Utah, USA.

    Vehicles involved:

    Vehicle 1:
    1991 Ibishu Covet 1.5 DX (M), 3-Door Hatchback, License: J79-3DH Utah Plate
    Date of registration: February 1992
Damage: Major front-end damage and rear damage. (Totaled)
    Occupants: 1. Darius Tilbrook (28)
Injuries: Major whiplash, 2 broken ribs, bruises and cuts

    Vehicle 2: 2006 Soliad Lansdale 3.3 S (A), 5-Door Minivan, License: S53-8HC Utah Plate
    Date of registration: September 2006
Damage: Rear-side damage, broken taillight, bent wheel and suspension axle. (Totaled)
    Occupants: 2, (19) male, (21) male
    Injuries: Unknown

    Vehicle 3: 1990 Gavril Grand Marshall V8 (A), 4-Door Sedan, License: R10-9TP Utah Plate
    Date of registration: March 1990
    Damage: Broken right-headlight, shunted bumper
    Occupants: 1, (37) male
    Injuries: None

    Aftermath:
Darius needed a few months to recover after that accident. Meanwhile authorities presumed the vehicle to be stolen and found two male suspects involved in another grand-theft-auto five months later. Which confessed to stealing that Lansdale and ditching quickly after the vehicle was rendered undrivable. Both vehicles were sent to the junkyard and still remain there to this day. The Grand Marshall driver later went home without any trouble. But his vehicle has been sitting in an auction yard waiting to be sold. The suspects were charged and after Darius' recovery he bought himself a better vehicle, because if it was any faster the Covet might've killed him.

    Direct aftermath:

The crossing was closed off. The driver of the Vertex managed to get out of his car, but collapsed almost afterwards. He was rushed to the hospital. The f-r-door of the Lansdale did not open, and the passenger there had to be freed by fire rescue.

    Medical history:
There wasn't anything unusual found in both medical reports.

    Vehicle history:
There wasn't anything unusual found in both vehicle reports.

    Right-Of-Way:
The driver of the Vertex had right of way. In the CCTV, it seemed like the Lansdale did not stop for the stop sign, but rather in the middle of the road. The driver said this was due to panic.

    Speed Gavril:
The black box of the Gavril read: 14:06:45, Location Belasco, 73 mph. This clearly implies that the driver of the Gavril was speeding. The driver blamed it on an issue with the black box, but the speed calculated was between 71 and 76 mph, more than double the speed limit.

    Mobile phone usage Lansdale:
Police found a broken phone in the Lansdale. The officers then went to check it, on suspicion that it was used while driving, hence texting-and-driving. That turned out to be partially true, the phone being used as a navigation placed in a phone holder.

    Causes:
    • Driver Lansdale failing to yield for a stop sign.
    • Driver Lansdale stopping in the middle of the road when the Gavril came.
    • Driver Vertex speeding.
