does the issue of the menu not unpausing when you close it happen every time? or only with specific steps?

Check if you have "Pause" and "Menu" on the same button in the Controls options. The button should only have the "Menu" action
the game should unpause when you close the menu again, unless you manually paused it before entering the menu with J.
