I was wondering if its legal to make real cars in BeamNG, I know officially they cannot be put on the mods page but can be released in a forum. Is there a creative common license for real cars?

If I make a real car like a 2019 Kia Optima could Kia Motors demand that I remove the mod?

Yup this is the main reason why i stopped making real cars, could spend 100s of hours creating it only to have it removed by the irl company

Then just create it as a fictional make/model. people have made tons of models and had no issue from the actual car company so i dont think you would have an issue.

Ya know... that's something that I have always wondered about... is the reason that they don't come to pull it down because they are fine with just a name change (Supra to Prasu for instance) or is it that they just couldn't find it to get angry at because it isn't named the right thing :p

Edit: I say that because I am not even going to pretend to know the legal bounds or implications of such a thing. Like... how much do you have to change before you can honestly say it's "not the same"... as it seems like you don't have to change very much... and yet it also seems like it's "up to interpretation."

Rockstar may have purchased the copyright to make the Volvo 242 in game, also some manufactures release copyright of their older cars.

GTA5 is the bluepring of how you can make cars similar to the real thing and avoid copyright, any manufacture that tries to go after GTA5 is possibly wasting time and resources trying to prove copyright infringement

Is this why you stopped working on your '04 Elantra?

Yes although I could slightly modify the body style and rename it, or someone else could, the 3D model is there

Well, the manufacturer could force you to take it down. However, I don't think there are any cases of that happening ever, much less in the BeamNG community. Technically a car design is the intellectual property of the corporation that made it, but that's only really enforceable if you're making money using their car, and even then it's not too strictly enforced (eg. custom car shops modifying cars for profit). I would say there is no risk in making a mod of a real car.

That did happen when I had the Blue Bird bus mod on the resource page, the Blue Bird Corporation alerted BeamNG due to copyright, a case they may have won if challenged, i had to modify it and re-release the mod. Company's typically issue take down notices instead of outright suit unless the brand is somehow maligned to the point of a possible loss in revenue. For example when the Beef Industry wanted to sue Oprah Winfrey, commonly referred to as the Amarillo Texas beef trial.

May I ask what you're trying to achieve here? You're turning this thread into a debate over a question @Diamondback clearly answered for you, and it already seems like you knew the answer to the question you were asking before you even asked it....

disloyalpick continued the discussion once the original question was answered and it turned out to be a productive thread, now this thread is searchable, I don't see any debates happening can you point those out?

and it already seems like you knew the answer to the question you were asking before you even asked it....

    Your assumptions are wrong.

This was a legitimate question because copyright may only be infringed if the material is used to turn a profit, but sometimes it is infringed even if no profit is made. Also each country may modify some aspects of copyright, I live in a different country than the Dev's, add to that the forums release page may be viewed differently than the official resource page when it comes to said copyrights, with all this speculation its best and most expedient to ask that question on this forum.
